加拿大访客境内转工签政策结束：2024 年 8 月 28 日后如何申请

2024 年 8 月 28 日，IRCC 立即终止了允许部分加拿大境内访客申请雇主支持工签的临时公共政策。

这项临时政策曾经提供什么

该政策在疫情期间推出，为部分原本必须从境外申请工签的合格访客提供了豁免；部分曾持工签的人在新申请审理期间，还可以请求临时工作授权。

IRCC 确认，2024 年 8 月 28 日之前已经递交的申请可继续按照旧政策审理。尚未在该日期前递交的人，不能仅因为已经取得职位或 LMIA 就继续依赖该政策。

政策结束不代表什么

这并不等于所有境内工签申请都被取消；能否境内申请取决于具体法规、公共政策或项目。访客身份本身也从不授权工作，外国人在开始就业前必须另有有效工作授权。

旧文章中关于“边境换签”的建议也应谨慎对待。加拿大后来限制并广泛终止通过 flagpoling 办理工签和学签。当前申请应以今天合法可用的流程规划，而不能依赖旧的边境做法。

实际应对

  • 确认具体工签类别及法律允许的申请地点；
  • 在加拿大期间维持有效临时居民身份；
  • 不要仅凭 Job Offer、LMIA 或在审申请开始工作；
  • 确认是否需要恢复身份或转换其他身份。
