Applying for a Spousal Open Work Permit from a Third Country: Status, Ties and Eligibility

A spouse may be eligible for an open work permit yet still face questions about temporary residence, lawful status in the country of application and the credibility of the overall plan.

Eligibility is only the first question

Spousal open work permit rules have changed significantly since this article was first published. Current eligibility depends on the principal foreign national’s status, program or occupation and the specific public policy or regulatory category. Applicants should not rely on a 2024 eligibility summary.

Where an application is made from a country other than the applicant’s country of citizenship, the record should clearly establish lawful admission or status there and explain why the application is being made from that location.

Temporary intent still matters

An open work permit is temporary status. A future intention to seek permanent residence is not automatically disqualifying, because Canadian law recognizes dual intent, but the officer must still be satisfied that the applicant will comply with the authorized period of stay if permanent residence is not obtained.

A coherent application

  • prove the genuine spousal or common-law relationship;
  • establish the principal applicant’s status and the category supporting eligibility;
  • document lawful status in the third country;
  • explain finances, travel history and the family’s practical plan;
  • address previous refusals and any inconsistencies directly.

The strongest application connects eligibility, temporary-residence compliance and the family’s evidence into one consistent account.
